Por su naturaleza, los datos p\u00fablicos pueden estar contenidos, entre otros, en registros p\u00fablicos, documentos p\u00fablicos, gacetas, boletines oficiales y sentencias judiciales debidamente ejecutoriadas que no est\u00e9n sometidas a reserva.<\/p><p><strong>Encargado del Tratamiento: <\/strong>Es la persona, natural o jur\u00eddica, que por s\u00ed misma o en asociaci\u00f3n con otros, realiza el Tratamiento de los Datos Personales por cuenta de Intelab.<\/p><p><strong>Personal de Intelab: <\/strong>Todas las personas vinculadas a Intelab que se encargan del tratamiento de datos personales, y que deber\u00e1n cumplir esta Pol\u00edtica de Protecci\u00f3n de Datos Personales.<\/p><p><strong>Responsable del Tratamiento: <\/strong>Es Intelab cuando por s\u00ed misma o en asociaci\u00f3n con otros, decida sobre las finalidades y el tratamiento de los Datos Personales que est\u00e9n contenidos en sus Bases de Datos.<\/p><p><strong>Titular: <\/strong>Persona natural cuyos Datos Personales sean objeto de Tratamiento.<\/p><p><strong>Transferencia: <\/strong>Es el env\u00edo de Datos Personales que realiza un Responsable y\/o Encargado del Tratamiento de Datos Personales ubicado en Colombia a un Responsable del Tratamiento que se encuentra dentro o fuera del pa\u00eds.<\/p><p><strong>Transmisi\u00f3n: <\/strong>Es el Tratamiento de Datos Personales que implica la comunicaci\u00f3n de aquellos, dentro o fuera del territorio de Colombia, realizada por el Encargado por cuenta del Responsable.<\/p><p><strong>Tratamiento: <\/strong>Es cualquier operaci\u00f3n o conjunto de operaciones sobre Datos Personales, tales como la recolecci\u00f3n, almacenamiento, uso, circulaci\u00f3n o supresi\u00f3n.<\/p><h4><a name=\"_Toc77123551\"><\/a>4.\u00a0\u00a0\u00a0\u00a0 PRINCIPIOS DEL TRATAMIENTO DE DATOS PERSONALES<\/h4><p>Para el Tratamiento de los Datos Personales, Intelab tendr\u00e1 en cuenta los siguientes principios:<\/p><p><strong>Principio de Legalidad en Materia de Tratamiento de Datos: \u00a0<\/strong>El Tratamiento de los Datos Personales se sujetar\u00e1 a lo establecido en las leyes aplicables en la materia para Colombia y en las dem\u00e1s disposiciones que desarrollen estas leyes.<\/p><p><strong>Principio de Finalidad: <\/strong>El Tratamiento obedecer\u00e1 a una finalidad leg\u00edtima de acuerdo con la Constituci\u00f3n y la Ley de Colombia, la cual ser\u00e1 informada a la persona Titular de los Datos Personales.<\/p><p><strong>Principio de Libertad: <\/strong>El Tratamiento solo podr\u00e1 ejercerse con el consentimiento, previo, expreso e informado de la persona Titular. Los Datos Personales no ser\u00e1n obtenidos o divulgados sin previa autorizaci\u00f3n, o en ausencia de mandato legal o judicial que releve el consentimiento.<\/p><p><strong>Principio de Veracidad o Calidad: <\/strong>La informaci\u00f3n sujeta a Tratamiento ser\u00e1 veraz, completa, exacta, actualizada, comprobable y comprensible.<\/p><p><strong>Principio de Transparencia: <\/strong>Se garantizar\u00e1 el derecho de la persona Titular a obtener informaci\u00f3n sobre sus Datos Personales en cualquier momento y sin restricciones, por parte de Intelab o del Encargado del Tratamiento de los Datos Personales.<\/p><p><strong>Principio de Acceso y Circulaci\u00f3n Restringida: <\/strong>El Tratamiento se sujetar\u00e1 a los l\u00edmites que se derivan de la naturaleza de los Datos Personales, de las disposiciones de las leyes aplicables para la materia y, de manera particular, de esta Pol\u00edtica. Es decir, los Datos Personales, salvo la informaci\u00f3n p\u00fablica, no estar\u00e1n disponibles en Internet u otros medios de divulgaci\u00f3n o comunicaci\u00f3n masiva, salvo que el acceso sea t\u00e9cnicamente controlable para brindar un conocimiento restringido s\u00f3lo a las personas Titulares o terceros autorizados.<\/p><p><strong>Principio de Seguridad: <\/strong>Los Datos Personales sujetos al Tratamiento de Intelab o al de su(s) Encargado(s) atender\u00e1n a las medidas t\u00e9cnicas, humanas y administrativas que sean necesarias para otorgar seguridad a los Datos Personales evitando su adulteraci\u00f3n, p\u00e9rdida, consulta, uso o acceso no autorizado o fraudulento.<\/p><p><strong>Principio de Confidencialidad: <\/strong>Todo el Personal de Intelab que intervenga en el Tratamiento de Datos Personales estar\u00e1 obligados a garantizar la reserva de los mismos, inclusive despu\u00e9s de finalizada su relaci\u00f3n con alguna de las labores que comprende el Tratamiento, pudiendo s\u00f3lo realizar suministro o comunicaci\u00f3n de Datos Personales cuando ello corresponda al desarrollo de las actividades autorizadas en la ley.<\/p><h4><a name=\"_Toc77123552\"><\/a>5.\u00a0\u00a0\u00a0\u00a0 TRATAMIENTO DE DATOS PERSONALES<\/h4><h4>5.1. <a name=\"_Toc77123553\"><\/a>Obtenci\u00f3n y Tratamiento al cual ser\u00e1n sometidos los Datos Personales<\/h4><p>Intelab garantiza que solo realiza el Tratamiento de los Datos Personales de las personas que de manera previa y expresa han autorizado dicho Tratamiento. Intelab conservar\u00e1 evidencia de la autorizaci\u00f3n para los fines legales conducentes, o bien, para que la persona Titular de los Datos Personales, en el momento que lo desee, y siempre y cuando sea procedente, revoque su autorizaci\u00f3n y solicite la supresi\u00f3n de su informaci\u00f3n.<\/p><p>En la solicitud de autorizaci\u00f3n, Intelab entregar\u00e1 toda la informaci\u00f3n relacionada con el Tratamiento al cual ser\u00e1n sometidos los Datos Personales de cada Titular, incluyendo, cuando aplique, informaci\u00f3n relacionada con la transmisi\u00f3n o transferencia de los Datos Personales a terceros.<\/p><p>Cuando la obtenci\u00f3n de los Datos Personales se derive de la celebraci\u00f3n de un contrato, los t\u00e9rminos y condiciones particulares del Tratamiento de los mismos se encontrar\u00e1n documentados en los contratos suscritos con las personas Titulares. Por lo anterior, cuando un proveedor, trabajador, o, en su caso, un cliente, firme el correspondiente contrato, se dar\u00e1 por entendido que est\u00e1 dando su consentimiento, expreso e informado, para que Intelab realice el Tratamiento de su informaci\u00f3n en relaci\u00f3n con la ejecuci\u00f3n de ese contrato.<\/p><p>Asimismo, cuando las personas Titulares de los Datos Personales entreguen su informaci\u00f3n a Intelab de manera voluntaria e unilateral, se entender\u00e1 que dieron su autorizaci\u00f3n expresa para el Tratamiento de estos datos con la finalidad estrictamente relacionada con el tr\u00e1mite o solicitud realizada a Intelab.<\/p><p>Se le informa que Intelab no estar\u00e1 obligada a solicitar la autorizaci\u00f3n de la persona Titular de los Datos Personales, en los siguientes casos: i) para informaci\u00f3n requerida por una entidad p\u00fablica o administrativa en ejercicio de sus funciones legales o por orden judicial; ii) cuando se trate de datos de naturaleza p\u00fablica; iii) en los casos de urgencia m\u00e9dica o sanitaria; iv) cuando el Tratamiento sea autorizado por la ley para fines hist\u00f3ricos, estad\u00edsticos o cient\u00edficos; y, v) cuando se trate de datos relacionados con el Registro Civil de las Personas.<\/p><h4><a name=\"_Toc77123554\"><\/a>5.2. Acceso a los Datos Personales<\/h4><p>La informaci\u00f3n almacenada en las Bases de Datos de Intelab podr\u00e1 ser compartida internamente a los trabajadores encargados de realizar el Tratamiento de los Datos Personales de conformidad con las finalidades mencionadas en esta Pol\u00edtica y\/o en la solicitud de autorizaci\u00f3n para el Tratamiento otorgada por la persona Titular.<\/p><p>Intelab no compartir\u00e1 o entregar\u00e1 Datos Personales almacenados en sus Bases de Datos con terceras personas no relacionadas con esta sociedad. Sin embargo, y cuando la finalidad as\u00ed lo requiera, los Datos Personales podr\u00e1n ser leg\u00edtimamente transmitidos o transferidos a aliados comerciales o proveedores de servicios de Intelab, para cumplir con objetivos contractuales o comerciales espec\u00edficos. En estos casos, y ante la imposibilidad de solicitar la autorizaci\u00f3n previa para el Tratamiento de los Datos Personales, la persona Titular acepta que con el env\u00edo de la informaci\u00f3n a Intelab autoriza el Tratamiento de sus datos en relaci\u00f3n con la finalidad para la cual hayan sido enviados.<\/p><p>Los casos en los que la autorizaci\u00f3n t\u00e1cita aplica, incluye pero no se limitan al env\u00edo de informaci\u00f3n: i) personas que desean trabajar en Intelab (personas candidatas a empleo); ii) personas que desean vincularse como proveedores de Intelab (Prospectos de Proveedores); iii) personas que desean obtener los productos o servicios de Intelab (Prospectos de Clientes); iv) personas a las que ser\u00e1 prestado un servicio prestado por Intelab; v) visitantes de la Web.<\/p><p>Sin perjuicio de lo anterior, se solicitar\u00e1 la autorizaci\u00f3n correspondiente para continuar con el Tratamiento de los Datos Personales.<\/p><h3>\u00a0<\/h3><h3>5.11 Prohibici\u00f3n o revocatoria de autorizaci\u00f3n para el Tratamiento de los Datos Personales<\/h3><p>Las personas Titulares son libres para prohibir o no autorizar el Tratamiento de sus Datos Personales por parte de Intelab, salvo en ocasiones que por requerimientos legal o contractual sea necesaria la conversaci\u00f3n de estos datos. No obstante, en caso de que algunos clientes, proveedores, trabajadores actuales o desvinculados no autoricen el uso de sus Datos Personales o soliciten la revocatoria de la autorizaci\u00f3n para el Tratamiento de sus Datos Personales, es posible que Intelab no pueda continuar con la relaci\u00f3n comercial o no pueda continuar prestando servicios por no contar con la informaci\u00f3n necesaria para estos fines.<\/p><p>En ese sentido, en caso de insistencia por parte de la persona Titular de los datos sobre la revocatoria de autorizaci\u00f3n para el Tratamiento de los Datos Personales, Intelab no se hace responsable por el incumplimiento precontractual o contractual, o por la cesi\u00f3n de beneficios particulares a los que puedan acceder terceros con los que Intelab se comunica de manera constante, como consecuencia de la no autorizaci\u00f3n o su revocatoria para el Tratamiento de datos personales.<\/p><h2>\u00a0<\/h2><h4>6. Con este fin, Intelab podr\u00e1 solicitar a sus clientes, proveedores y trabajadores que los actualicen de manera permanente.<\/p><p>\u00a0<\/p><h4><strong>6.2 Derecho a solicitar prueba de la autorizaci\u00f3n:<\/strong><\/h4><p>Las personas Titulares de los Datos Personales podr\u00e1n solicitar prueba de la autorizaci\u00f3n otorgada para el Tratamiento de sus datos, salvo en los casos se\u00f1alados en el numeral 5.9 de esta Pol\u00edtica.<\/p><p>\u00a0<\/p><h4>6.3 Derecho a ser informado frente al uso que se le ha dado a sus Datos Personales:<\/h4><p>Las personas Titulares de Datos Personales tienen derecho a conocer en cualquier momento el uso que se les ha dado a sus Datos Personales, previa solicitud dirigida a Intelab o a su Encargado.<\/p><p>\u00a0<\/p><h4>6.4 Derecho a revocar la autorizaci\u00f3n y\/o a solicitar la supresi\u00f3n del dato personal:<\/h4><p>Las personas Titulares de Datos Personales podr\u00e1n revocar la autorizaci\u00f3n otorgada a Intelab para el Tratamiento de sus Datos Personales, si evidencia que no han sido respetados los principios, derechos y garant\u00edas constitucionales y legales, as\u00ed como tambi\u00e9n a solicitar la supresi\u00f3n de los Datos Personales sobre los cuales su Tratamiento no est\u00e1 expresamente prohibido o no haya sido autorizado.<\/p><h4>6.5 Derecho a acceder a sus Datos Personales:<\/h4><p>Las personas Titulares de Datos Personales objeto de Tratamiento podr\u00e1n acceder de forma gratuita a los mismos.<\/p><p>\u00a0<\/p><h4><strong>6.6<\/strong> Derecho a presentar quejas:<\/h4><p>Las personas Titulares de Datos Personales podr\u00e1n presentar ante la Superintendencia de Industria y Comercio quejas por infracciones a lo dispuesto en la normatividad vigente.<\/p><p>\u00a0<\/p><h4>6.7 Derecho a abstenerse de responder preguntas sobre datos sensibles:<\/h4><p>Las personas Titulares de Datos Personales objeto de Tratamiento podr\u00e1n abstenerse a responder preguntas sobre datos sensibles. Tendr\u00e1 car\u00e1cter facultativo las respuestas que versen sobre datos sensibles o sobre datos de las ni\u00f1as y ni\u00f1os y adolescentes.<\/p><h2>\u00a0<\/h2><h4>7. RESPONSABLE DIRECTO DE LA ATENCI\u00d3N DE PETICIONES, CONSULTAS O RECLAMOS<\/h4><p>La persona Titular de la Informaci\u00f3n puede ejercitar su derecho a conocer, acceder, actualizar, rectificar y suprimir sus datos personales en los t\u00e9rminos previstos en la Ley 1581 de 2012, y sus decretos reglamentarios, de manera gratuita, al menos una vez cada mes calendario, y cuando se trate de reclamos siempre que haya un motivo para ello, mediante carta acompa\u00f1ada de copia del documento de identidad.<\/p><p>Los canales establecidos por Intelab\u00a0para el ejercicio de sus derechos como Titular es el Correo electr\u00f3nico: <a href=\"mailto:datos.personales@olartemoure.com\">privacidad@intelab.com.mx.<\/a><\/p><h4>\u00a0<\/h4><h4>8. PETICIONES O CONSULTAS<\/h4><p>La persona titular o sus causahabientes podr\u00e1n presentar peticiones o consultas ante Intelab, bajo las siguientes reglas:<\/p><ul><li>La consulta o petici\u00f3n deber\u00e1 dirigirse al correo electr\u00f3nico: <a href=\"mailto:datos.personales@olartemoure.com\">privacidad@intelab.com.mx.<\/a><\/li><li>En el correo electr\u00f3nico, la persona Titular deber\u00e1 identificarse plenamente y describir de manera clara su petici\u00f3n o consulta. En caso de que no se est\u00e9 actuando como Titular, por favor indicar la calidad en la que se act\u00faa y adjuntar el documento que acredite sus facultades para realizar la petici\u00f3n o consulta, bien sea poder, registro civil, entre otros.<\/li><li>Intelab atender\u00e1 su petici\u00f3n o consulta en un t\u00e9rmino m\u00e1ximo de diez (10) d\u00edas h\u00e1biles contados a partir de la fecha de recibo de la consulta.<\/li><li>Cuando no fuere posible atender la consulta dentro del t\u00e9rmino mencionado, Intelab informar\u00e1 al interesado expresando los motivos de la demora y se\u00f1alando el nuevo t\u00e9rmino para atender su petici\u00f3n o consulta, el cual no superar\u00e1 cinco (5) d\u00edas h\u00e1biles, contados a partir del vencimiento del t\u00e9rmino en el anterior punto.<\/li><\/ul><p>\u00a0<\/p><h4>9. RECLAMOS<\/h4><p>\u00a0<\/p><p>La persona titular o sus causahabientes podr\u00e1n presentar un reclamo ante Intelab, bajo las siguientes reglas:<\/p><ul><li>La solicitud de correcci\u00f3n, actualizaci\u00f3n o supresi\u00f3n de Datos Personales deber\u00e1 dirigirse al correo electr\u00f3nico: <a href=\"mailto:datos.personales@olartemoure.com\">privacidad@intelab.com.mx<\/a><\/li><\/ul><p>-En el correo electr\u00f3nico, la persona Titular deber\u00e1 identificarse plenamente. En caso de que no se est\u00e9 actuando como Titular, por favor indicar la calidad en la que se act\u00faa y adjuntar el documento que le otorga facultades para realizar la petici\u00f3n o consulta.<\/p><p>-En caso de que el reclamo tenga relaci\u00f3n con un posible incumplimiento de cualquiera de los deberes de Intelab, se deber\u00e1 indicar de manera detallada la raz\u00f3n del incumplimiento.<\/p><ul><li>En caso de que el reclamo resulte incompleto, Intelab requerir\u00e1 al interesado dentro de los cinco (5) d\u00edas h\u00e1biles siguientes al recibo del mismo para que lo subsane respecto de sus imprecisiones. Transcurridos dos (2) meses desde la fecha del requerimiento, sin que el solicitante presente la informaci\u00f3n requerida, Intelab entender\u00e1 que se ha desistido del reclamo.<\/li><\/ul><ul><li>En caso de que Intelab reciba un reclamo del que no sea competente para resolver, dar\u00e1 traslado a quien corresponda en un t\u00e9rmino m\u00e1ximo de dos (2) d\u00edas h\u00e1biles e informar\u00e1 de la situaci\u00f3n al interesado.<\/li><li>Una vez recibido el reclamo completo, Intelab incluir\u00e1 en la Base de Datos correspondiente una leyenda que diga <em>&#8220;reclamo en tr\u00e1mite&#8221;<\/em> y el motivo del mismo, en un t\u00e9rmino no mayor a dos (2) d\u00edas h\u00e1biles. Dicha leyenda se mantendr\u00e1 hasta que el reclamo sea decidido.<\/li><li>Intelab atender\u00e1 el reclamo en un t\u00e9rmino m\u00e1ximo de quince (15) d\u00edas h\u00e1biles contados a partir del d\u00eda siguiente a la fecha de su recibo.<\/li><li>Cuando no fuere posible atender el reclamo dentro de dicho t\u00e9rmino, Intelab informar\u00e1 al interesado los motivos de la demora y la fecha en que se atender\u00e1 su reclamo, la cual en ning\u00fan caso podr\u00e1 superar los ocho (8) d\u00edas h\u00e1biles siguientes al vencimiento del primer t\u00e9rmino.<\/li><\/ul><p>\u00a0<\/p><h4>10. PERSONAS AUTORIZADAS PARA EL SUMINISTRO DE INFORMACI\u00d3N SOBRE LOS DATOS PERSONALES<\/h4><p>Para todos los efectos, Intelab solo podr\u00e1 entregar informaci\u00f3n contenida en sus Bases de Datos a:<\/p><ol><li>Las personas Titulares, sus causahabientes o sus representantes legales.<\/li><li>Las entidades p\u00fablicas o administrativas en ejercicio de sus funciones legales o por orden judicial.<\/li><li>Los terceros autorizados por la persona Titular o por la ley.<\/li><\/ol><p>Intelab se reserva el derecho de solicitar documentaci\u00f3n adicional a fin de verificar la calidad de la persona que solicita la informaci\u00f3n.<\/p><p>\u00a0<\/p><h4>COOKIES Y TECNOLOG\u00cdAS SIMILARES<\/h4><p>Intelab podr\u00e1 usar Cookies y tecnolog\u00edas similares para la recolecci\u00f3n de datos mediante su p\u00e1gina web: <a href=\"https:\/\/www.olartemoure.com\/\">http:\/\/www.Intelab.com.mx<\/a><\/p><p>Intelab podr\u00e1 usar cookies para asegurar el correcto funcionamiento de sus servicios, de su p\u00e1gina web, almacenar sus preferencias, conocer su experiencia de navegaci\u00f3n, recopilar informaci\u00f3n sobre los servicios obtenidos, entre otros.
